SERVICE POLICY

We value your business and want you to have the best possible renting experience. We provide these guidelines to help you understand our expectations and to minimize any confusion about the rental process.

No Responsibility To Sell Mispriced Products Or Services

BookRenter.com, Inc. shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. BookRenter.com, Inc. shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit/debit card charged. If your credit/debit card has already been charged for the purchase and your order is canceled, BookRenter.com shall immediately issue a credit to your credit/debit card account in the amount of the charge.

Purchasing Books

When you purchase a book from BookRenter.com, Inc. your credit/debit card will be charged for the purchase price of the book once it ships. When you receive your book from BookRenter.com, Inc, the book becomes your property.

Rental Prices

Prices of rentals are not guaranteed until you check out and submit your credit/debit card information to complete your transaction.

Returning Books

Please mail your books back by the last day of your rental period. (For more information on our return process visit the How to Return page). A prepaid shipping label is available on your BookRenter.com account; it is your responsibility to print out and affix the prepaid shipping label to the outside of your return shipment. All items that originally came with the book, such as, CDs, DVDs, access codes, inserts, workbooks, study guides, etc. must be returned with the book. Also please ensure that only required items are included in your return shipment. BookRenter.com, Inc. is not responsible for any items lost because they were shipped back with your book.

The above instructions are not the same for returning books for a refund. If you want to return a book because it is damaged or the incorrect title, or because you simply do not want it anymore, see the Refunds Section below.

All return shipments MUST use the BookRenter.com shipping label printed during our return process. BookRenter.com, Inc. is not responsible for any shipment that does not follow our return procedure. This includes: (1) Shipments that do not use a BookRenter.com shipping label; (2) Shipments that do not include the BookRenter.com packing slip; and 3) Shipments not properly dropped off at a UPS location. (You are not allowed to request a UPS pick up. If you do, your account will be charged for the associated cost.)

Please note that our website will be down occasionally for regular maintenance during off peak hours. We try to keep downtime as short and infrequent as possible, but it is always best to print your return shipping label a couple days before you plan on sending back your books. BookRenter.com, Inc. is not responsible for books that are returned late due to our website being down for maintenance.

Time Frame

Your rental begins on the date your book is delivered, based on your tracking number, and must be postmarked for return by the last day of your rental period. Otherwise, we assume you are keeping your book and we will charge you accordingly (see the Books Not Returned By Due Date Section ).

Books Not Returned By Due Date

If your book is not postmarked by the end of your rental period, you will be charged 20% of the book's list price (a.k.a. a late fee) and your rental will be extended by 14 days. If your book has not been returned by the end of this 14 day extension, you will be charged a Book Never Returned fee, which is used to cover the cost of replacing the book. This fee is equal to 140% of the book's list price minus your rental costs and the cost of the late fee, plus a $10.00 service fee. Once you are charged the Book Never Returned fee, you opt out of the rental agreement and the book becomes your property.

If you have not returned the book by the due date and we are unable to charge your credit/debit card, it is your responsibility to pay the fee immediately. You will be notified via email if your credit/debit card was declined and have 15 days to pay this fee before your account is turned over to a third-party collection agency. All accounts sent to collections are subject to an additional $25.00 fee.

Purchasing Your Rental

If you like your rental, we encourage you to buy it. To buy a book you are renting, go to the Extensions/Buyouts Page , choose the "convert rental to purchase" option for the rental you wish to purchase and proceed with checkout. Upon completion of the checkout process, you opt out of the rental agreement and the book becomes your property.

Extending Your Rental

If you wish to keep your book past the due date, you can extend your rental by 10, 30, 45, 60, or 90 days. To extend a rental, go to Extensions/Buyouts Page , choose the appropriate extension period for the rental you wish to extend and proceed with checkout. Once you have completed checkout, your rental period will automatically be extended by the number of days selected.

Property

During your rental period, all books remain the full property of BookRenter.com, Inc. Your acceptance of the book and paying rental prices entitles you to use the property of BookRenter.com, Inc. for a limited amount of time and binds you to our Service Policy. At the end of the rental period, you exit out of the service policy and lose all rights to the book.

Lost Books

If your rented book is lost or stolen, you are responsible for the book. If you do not return the book at the end of your rental period, your credit/debit card will be charged to replace the book (see the Books Not Returned By Due Date Section ).

Damaged Books

Books are required to be kept in like-new or better condition. If a book is arrives to you damaged, you need to notify Customer Service within 3 days of when it is delivered - see the Refunds section below for more information.

If a book is returned to us as damaged and rendered unusable, it will remain the property of BookRenter.com and you will be charged the full retail value to replace it. If supplementary materials such as CDs, workbooks, study guides, etc. are included with your book, they must be returned with your book. For examples of like-new and damaged books and what counts as a minor or major damage fee, please refer to the examples below.

Required Condition - No Damage Fee
Firm cover with no noticeable damage. All pages must be intact (no creases, tears, or stains present). There can be minimal writing or highlighting, but no damage to the binding.
Unacceptable Condition - Damage Fee Applies
Minor Damage (35% of list price*)

Light damage to the cover (markings on the inside or outside, or portions ripped off) or pages (medium to large creases, tears, stains, or liquid damage) is present.

Major Damage (full list price*)

The cover is noticeably damaged or missing. Pages are stained, missing, illegible, or otherwise warped. There is heavy writing and/or highlighting throughout the book. Any other case that renders the book unusable will also result in a major damage fee.

  • *List price is the list price of the book advertised on our site at the time of checkout.

Highlighting

Acceptable levels of writing and highlighting are allowed. If a book is returned with a copious amount of writing or highlighting, a damage fee may be charged (see above section).

What We Rent

We only rent books that can be reused; workbooks, study guides, laboratory manuals, periodicals, and other consumable materials are not rented. Furthermore, we do not guarantee that access codes/keys/cards, CDs, DVDs, workbooks, or any other type of supplemental material will come with books purchased or rented. If a book you rent or buy from BookRenter arrives with a supplement, you are allowed to use it at no extra cost. At the end of the rental, all supplemental material must be returned with the book rented.

Intellectual Property

All rented items are protected by applicable Federal Copyrights. Materials should not be reproduced or used without express written permission from BookRenter.com, Inc. or any of its suppliers. BookRenter.com, Inc. reserves the right to terminate your account and rental if we, in its sole and absolute discretion, believe that you are in violation of these terms. Such violations include copying, scanning, photocopying, or reproducing in anyway CDs or written publications rented to you. BookRenter.com, Inc. does not promote, foster or condone the copying of CDs or any written publications nor does it condone any other infringing activities. The use of CDs and publications rented to you is solely for your personal and non-commercial use.

Payment Information

It is the responsibility of the customer to keep accurate payment information. You will be notified via email of an invalid credit/debit card and given the opportunity to pay your outstanding dues. It is the person listed under the Billing Information of an account who is responsible for payment of the rental and any associated additional charges. This billing information is held on file until all books in an order are closed.

BookRenter.com is not responsible for causing or refunding overdraft or other penalty fees a customer may receive for a credit or debit card going over its limit or being overdrawn. BookRenter.com, Inc. reserves the right to use a collection agency and any other means necessary to recover lost assets or any payments due. All accounts sent to collections are subject to an additional $25.00 fee.

Books Not Received

If your book is not delivered to you within several business days of your delivery estimate or you receive a book you did not order, please inform Customer Service within 3 days of your order's delivery estimate/date. If BookRenter.com is not notified within this time frame, we will be unable to send a replacement or claim an order as lost and you will be liable for the book(s).

Third Party Collection

BookRenter.com, Inc. reserves the right to provide third parties with information relevant to the collection of any monies due for books not returned, extended without approval, or damaged beyond terms. We will disclose your personal information without your consent to protect or enforce our rights, to protect or enforce the rights of a third party, or as required by law.

Refunds

If you wish to return an item for a refund, please visit the refund page within 10 days of your item's delivery. From this page, you will be given a prepaid shipping label to return your book(s). You must postmark your return within 5 days of generating your return shipping label or within 5 days of receiving your order (whichever is later). BookRenter.com will not honor refunds on items shipped back late or refunds not using the BookRenter.com prepaid shipping label. All items must be returned in the condition in which they were received. Shrink-wrapped items cannot be returned if the wrapping is broken, unless the items are defective. In addition, we will not accept CDs, DVDs, or access codes/keys with broken seals for return. Failure to follow any of the above rules can result in your item becoming ineligible for a refund.

You will be notified via email once your return has been received and processed, which can take 2-4 weeks. Once the return has been processed, a refund will be posted to the credit/debit card you used to place your order. It normally takes 5-10 business days for financial institutions to process this transaction.

Refusing delivery is not an acceptable way to return an item for a refund. BookRenter.com is not responsible for items that are returned to sender. If an item's delivery is refused for any reason, BookRenter.com will make every effort to refund the customer minus a restocking fee (see below) as soon as the sender has received and successfully processed the refused shipment. There is, however, no guarantee when and if the refused shipment will be successfully processed.

Please see the below sections for the difference between refunds due to BookRenter.com's error and all other refunds.

Due to BookRenter.com's Error

If BookRenter.com makes a mistake with your order (e.g. books do not match your order or books with major damage are shipped), we will gladly refund you in full (including books, shipping and tax). To receive a refund, please visit the refund page within 10 days of your item's delivery date and postmark your item within 5 days of generating the return shipping label. Requests for refunds due to missing supplements are not the result of a BookRenter.com error and will be assessed a restocking fee (see below).

Items are no longer eligible for a refund after 10 days of receipt; in addition, if the book is returned to us damaged or not in its original condition, we will be unable to offer you a refund.

All Other Refunds

To receive a refund, please visit the refund page within 10 days of your item's delivery and ship back your item in original condition within 5 days of generating the return shipping label. You will be refunded for your entire order (including books, shipping, and tax), but will also be charged a restocking fee (see below).

Restocking Fees

Restocking fees apply to any refund that is not the result of a BookRenter.com error. They are used to help cover the cost of your original shipping charges, the cost of shipping items back to us, the processing of your return, and the credit card transaction fees associated with your order. Restocking fees are charged per item and based on the shipping method chosen during checkout.

Cancellations/Modifications

Because BookRenter.com tries to process and ship orders as quickly as possible, the majority of orders cannot be canceled or modified (books cannot be added, and rental periods and shipping addresses and methods cannot be changed, etc.) once placed. If you request to return an item for a refund by generating a label on the refund page , BookRenter.com will automatically try to cancel your item if it has not yet shipped. However, even if your item has not shipped, it most likely cannot be canceled or modified. If BookRenter.com is able to cancel your item, you will be sent an email confirming the cancellation and will not be charged for the item; otherwise, you will have to return the item for a refund. Please see the Refunds Section for more information.

Changes

By placing an order with BookRenter.com, Inc. you consent to our Service Policy. If we amend this Policy, we will post any changes to this page so that you are always aware of the current terms and conditions. We suggest that you check this page on occasion to keep up with the most up to date policy.

Governing Law

You agree that any claim relating to BookRenter.com, Inc. shall be governed by the laws of the State of California without regard to its conflict of law provisions and you consent to the exclusive jurisdiction over you and such claims, and to venue of such claims, being in the California Superior Court in the County of Santa Clara, California and the Federal District Court for the Northern District of California, San Jose Division.
